Bavarian Motors Inc. accused of infringing BMW marks

SAN FRANCISCO – A Burbank corporation and its owner are accused of using an imitation of BMW's logo without the vehicle manufacturer's authorization.

BMW of North America LLC and Bayerische Motoren Werke AG filed a complaint on June 19 in the U.S. District Court for the Central District of California, Western Division against Bavarian Motors Inc. and Nathan Malla alleging trademark infringement, cybersquatting and other counts.

According to the complaint, the plaintiffs allege that the defendants are using an imitation of their Roundel logo to advertise products and a similar name. The plaintiffs holds Bavarian Motors Inc. and Malla responsible because the defendants allegedly have never provided services for the plaintiffs and are not affiliated or sponsored by the plaintiffs.

The plaintiffs request a trial by jury and seek enjoin the defendants, profits, treble damages, order the defendant to deliver up for destruction all infringing materials, all legal fees and any other relief as the court deems just. They are represented by Brent D. Sokol and Alexis A. Smith of Jones Day in Los Angeles.
