Man seeks rescission of purchase contract from Paul S. Blancos Good Car Co. Fresno Inc.

FRESNO – A Fresno County man alleges that a vehicle he purchased was misrepresented.

Martin Mulverhill filed a complaint on June 9 in the Fresno County Superior Court against Paul S. Blancos Good Car Co. Fresno Inc., Capitol One Auto Finance Inc. and Does 1-10 alleging fraud and deceit and other counts.

According to the complaint, the plaintiff alleges that he signed a contract with Blancos in February 2013 for a 2011 Ford Fusion. He alleges that the vehicle he purchased has a different VIN than what was listed on the documents, registration and insurance, so the vehicle is rendered undrivable and useless.

The plaintiff holds Paul S. Blancos Good Car Co. Fresno Inc., Capitol One Auto Finance Inc. and Does 1-10 responsible because defendant Paul Blancos allegedly intentionally delivered a completely different vehicle and misrepresented that said vehicle was in sound mechanical condition and without a history of prior material defects, damage or repair.

The plaintiff seeks rescission of the purchase contract, actual and exemplary damages, attorney's fees, costs and expenses and such other just and proper relief. He is represented by Jeremiah L. Paul of Crest Law Group LLP in Fresno.
