Student, parents, sister blame school district, officials for sexual assault

FRESNO — A Fresno County family is suing a local school district and officials, alleging sexual abuse, negligence and intentional infliction of emotional distress.

Jane Doe, Mariano Doe, Rosa Doe and Layla Doe filed a complaint June 12 in Fresno County Superior Court against the Parlier Unified School District, Youth Centers of America, Francisco Pena and Does 1-100, alleging the district and Does 1-25 breached their duty to protect Jane Doe from Pena’s criminal conduct.

According to the complaint, on May 16, 2016, Jane Doe was raped by defendant Pena at Youth Centers of America in Parlier. Due to humiliation, the suit says, Jane Doe attempted suicide on three occasions. 

The plaintiffs say they suffered severe emotional distress. They allege Pena encouraged Jane Doe to drink hard alcohol and then engaged her in sexual intercourse and that the Parlier Unified School District negligently handled its investigation into the case.

The plaintiffs seek trial by jury, all damages and all other just and proper relief. They are represented by attorneys James A. Quadra and Rebecca M. Coll of Quadra & Coll LLP in San Francisco.
