Employee seeks payment of medical costs from Epsilon Systems Solutions Inc.

SAN DIEGO – A man injured in the jurisdiction of the Southern District of California alleges that his employer has failed to comply with an order to pay for medical care.

Charles Reed filed a complaint on June 16 in the U.S. District Court for the Southern District of California against Epsilon Systems Solutions Inc. and Signal Mutual Indemnity Association alleging that the defendants violated the Longshore and Harbor Workers' Compensation Act and the Medicare Secondary Prayer Act.

According to the complaint, the plaintiff alleges that on Aug. 18, 2008, plaintiff injured his left upper extremity while working for defendant Epsilon and the defendants negotiated an interim settlement to provide plaintiff medical care compensation for his injuries in 2015. Despite an order from the district director for the 18th Compensation District of the Office of Workers' Compensation Programs for the defendants to pay for certain medical care, the plaintiff alleges that the defendants have not paid for the costs.

The plaintiff holds Epsilon Systems Solutions Inc. and Signal Mutual Indemnity Association responsible because the defendants allegedly failed to comply with agreed terms of settlement and failed and refused to pay plaintiff's medical providers and or reimburse his group health insurers for medical costs arising from work injuries.

The plaintiff seeks an order enjoining the defendants to comply with the orders, prejudgment interest, costs of suit, attorney fees and such other and further relief as the court deems just and proper. He is represented by Eric A. Dupree and Paul R. Myers of Dupree Law in Coranado.
