Woman alleges Ford Focus is defective, seeks damages

FRESNO – A Fresno County woman alleges a Ford vehicle she purchased is defective and seeks rescission of the sales contract.

Vicki Lea Miller filed a complaint on June 12 in the Fresno County Superior Court against Ford Motor Co. and Does 1 through 20, inclusive alleging that the defendant violated the Song-Beverly Consumer Warranty Act.

According to the complaint, the plaintiff alleges that on May 13, 2016, and May 24, 2016, plaintiff signed two conditional sales contracts to purchase a 2012 Ford Focus from the defendant that was accompanied by the defendant's express vehicle warranty and express extended powertrain warranty. Plaintiff claims that the vehicle was defective and failed to perform properly and has since failed to conform to the terms of the warranties. She alleges that she took the vehicle to the defendant's franchise dealership seven times for repairs.

The plaintiff holds the defendant responsible because the defendant allegedly failed or refused to repair the vehicle so as to bring it into conformity with the implied warranties.

The plaintiff seeks for rescission of the contract, award for actual and exemplary damages, attorney's fees, costs of suit, prejudgment interest, and such other relief as the court deems just and proper. She is represented by Alicia L. Hinton of Law Office of A.L. Hinton in Fresno.
