Insurance company seeks more than $160,000 from Kintetsu World Express, BNSF Railway

LOS ANGELES – An insurance firm is seeking damages from two common carriers it alleges damaged cargo in transport.

Tokio Marine & Nichido Fire Insurance Co. LTD filed a complaint on June 26 in the U.S. District Court for the Central District of California against Kintetsu World Express Inc., BNSF Railway Co. and Does 1 through 10 alleging negligence and other counts.

According to the complaint, KWE received a shipment of automobile parts to be carried from Japan to Indiana via California in June 2016. The same month, the suit states that KWE tendered the cargo to BNSF for transport from Los Angeles to Indiana. The plaintiff alleges the defendants failed to deliver the cargo in good order and condition, costing it more than $160,000 in damages.

The plaintiff seeks general damages of $160,184.51 plus interest, all legal fees and any other relief as the court deems just. It is represented by Dennis A. Cammarano of Cammarano Law Group in Long Beach.
