Triple 8 Inc. alleges misuse of trade name by 888 Auto Broker LLC

Trademark 09

LOS ANGELES – A Los Angeles County licensed automobile retailer alleges that another business is using a similar and confusing trade name.

Triple 8 Inc. filed a complaint on June 27 in the U.S. District Court for the Central District of California against 888 Auto Broker LLC and Does 1 through 10 alleging trademark infringement and other counts.

According to the complaint, the plaintiff alleges that it suffered damages to its business from having its trademark infringed.

The plaintiff holds 888 Auto Broker LLC and Does 1 through 10 responsible because the defendants allegedly preyed on the Filipino community by using the same trademark as the plaintiff. The plaintiff alleges that it has not authorized the defendant to use its name or common marks and that the defendant is not affiliated with it in any way.

The plaintiff requests a trial by jury and seeks enjoin the defendant, order the defendant to destroy all infringing materials, special and general damages, punitive and exemplary damages, interest, all legal fees and any other relief as the court deems just. It is represented by Orlando F. Cabanday of Cabanday Law Group in Torrance.
