Man alleges he was injured when driver rear-ended vehicle in Fresno County

FRESNO – A Fresno County man has filed suit after a collision in the county.

Joseph Macedo filed a complaint on June 22 in the Fresno County Superior Court against Keith Walter Dungon and Ryder Truck Rental Inc., CCS Construction and Does 1 through 50, inclusive alleging negligence.

According to the complaint, the plaintiff alleges that on Sept. 28, 2016, while stopped at the stop sign located at the intersection of Brawley and Jensen avenues, plaintiff was struck in the rear end by defendant Dungon, which caused him to collide with another vehicle. The suit states Dungon was driving a truck owned and or supplied by Ryder and CCS.

As a result, Macedo claims he suffered serious, painful and permanent bodily injuries, undergone medical treatment and incurred medical costs and expenses. 

The plaintiff holds the defendants responsible because Dungon allegedly failed to reduce speed to avoid a collision and failed to observe due care and precaution and maintain proper adequate control of the motor vehicle.

The plaintiff seeks judgment for general and special damages, costs of suit incurred, second cause of action for punitive damages, and for such other and further relief as the court may deem just and proper.
