Hartford Accident & Indemnity Co. seeks subrogation for workers' compensation benefits

FRESNO – An insurance company alleges a wheel manufacturer and distributor should reimburse it for workers' compensation benefits.

Hartford Accident & Indemnity Co. filed a complaint on June 23 in the Fresno County Superior Court against Darnell-Rose, a subsidiary of Evans Industries Inc.; McMaster-Carr Supply Co. and Does 1-25 citing the California Labor Code and Workers' Compensation Act.

According to the complaint, the plaintiff insured Olam Holdings Partnership against liability for workers' compensation claims. The suit states that on July 27, an Olam Holdings Partnership employee was injured on the job when the wheels on a conveyer broke and a 700-pound load struck the employee in the face. The plaintiff has allegedly paid workers' compensation benefits of more than $22,000 so far. The suits the wheels were manufactured and/or sold by the defendants.

The plaintiff alleges it is entitled to reimbursement from the defendants for the workers' compensation benefits paid.

The plaintiff requests a trial by jury and seeks judgment for reimbursement of all amounts pain in workers' compensation benefits, and such other additional relief as the court may deem just and proper. It is represented by Jenna L. Fischer-Reyes of Law Offices of John A. Hauser in Santa Ana.
