Policy holder alleges insurance firm violated ERISA

SAN FRANCISCO — A former Clorox worker is suing an insurance company, alleging breach of contract and violation of the Employee Retirement Income Security Act.

Joshua Opoku filed a complaint July 13 in U.S. District Court for the Northern District of California against Standard Insurance Company, alleging the defendant wrongfully denied the plaintiff's claim for disability benefits.

According to the complaint, Opoku, who worked for Clorox as global insights manager until becoming disabled March 23, 2016, due to a a major back diorder. The suit says he applied for disability benefits but was denied. 

The plaintiff alleges Standard Insurance wrongfully upheld its decision to deny his long-term benefits despite Opoku being disabled according to the terms of the plan.

Opoku seeks long-term disability benefits payable at the rate of $5,416 per month since March 2016, plus interest, legal fees and any other relief the court deems just. He is represented by attorney Bernard R. Schwam of Law Office of Bernard R. Schwam in Encino, California.
