Customers allege Nissan violated warranties

FRESNO — A couple is suing Nissan, alleging breach of express warranty.

Matthew Peterson and Nelleta Peterson filed a complaint June 26 in Fresno County Superior Court against Nissan North America Inc. and Does 1-10, alleging they failed to comply with the Song-Beverly Consumer Warranty Act.

According to the complaint, on March 21, 2015, the Petersons purchased a new 2015 Nissan Pathfinder After purchase, the suit says, the vehicle has suffered from serious defects and non-conformities. The Petersons allege they have been damaged in the amount paid for the vehicle and other incidental and consequential damages. 

The plaintiffs allege the defendants have been unable and and refuses to conform the plaintiffs' vehicle to its applicable warranties.

The Petersons seek trial by jury, rescission of the contract, compensatory and general damages, pre-judgment interest, attorney fees,court costs and such further relief. They are represented by attorney Deborah L. Horowitz of California Lemonlaw Group Inc. in San Diego.
