Customer accuses General Motors, Ford of breaching warranties

FRESNO — A Fresno County woman is suing General Motors and Ford, alleging breach of express and implied warranties.

Maria L. Orrostieta filed a complaint June 27 in Fresno County Superior Court against General Motors LLC, Lithia Fresno, Ford Motor Company and Does 1-10, alleging they failed to comply with their obligations under the terms of the service contract.

According to the complaint, on July 2, 2016, Orrostieta purchased a 2013 Chevrolet Malibu for household purposes. During the warranty period, the vehicle developed defects, the suit says. 

Such defects, the lawsuit states, substantially impaired the use, value, or safety of the vehicle, causing Orrostieta to suffer damages of at least $25,000. 

The plaintiff alleges the defendants failed to repair the vehicle to conform it to the applicable warranties and failed and refused to promptly replace the vehicle or make restitution.

Orrostieta seeks trial by jury, actual damages, civil penalties, restitution, costs of the suit, attorney fees, interest and all other just and proper relief. She is represented by attorneys Robert J. Pecora and Brian K. Cline of Law Office of Pecora & Cline in La Jolla.
