Policy holder alleges Prudential violated ERISA

LOS ANGELES — A policy holder is suing Prudential Insurance, alleging breach of contract and violating the Employee Retirement Income Security Act.

Priscilla Dubose filed a complaint July 19 in U.S. District Court for the Central District of California against The Prudential Insurance Company of America, alleging the insurance firm wrongfully denied the plaintiff's claim for disability benefits while working for Michelin.

According to the complaint, Dubose became disabled in 2015 due to the condition of her lumbar spine and worsening myalgia. The suit says she applied for disability benefits but was denied. 

The plaintiff alleges Prudential Insurance wrongfully upheld its decision to deny Dubose's disability benefits despite her appeal and despite the word of a doctor who said she could not lift more than 10 pounds..

Dubose seeks benefits due, legal fees and all other relief the court deems just. She is represented by attorneys Frank N. Darras, Susan B. Grabarsky and Phillip S. Bather of DarrasLaw in Ontario, Calfornia.
