Cyclist blames truck driver for crash, injuries

SAN FRANCISCO — A cyclist is suing a truck driver and others, alleging their negligence led to injuries for the plaintiff.

Tracey Howell filed a complaint April 20 in San Francisco County Superior Court against Ernesto Garcia, CMC Traffic Control Specialists Inc., and Does 1 through 50, alleging their negligence led to Garcia's truck colliding with the plaintiff's bicycle.

According to the complaint, on April 23, 2015, Howell suffered physical injuries when her bicycle was hit by a truck on Golden Gate Avenue near Polk Street in San Francisco. Howell said she sustained injuries to her wrist. knee, shoulder, neck and back, and suffered severe shock to her nervous system. 

The plaintiff alleges Garcia failed to keep a proper lookout while operating his truck.

Howell seeks trial by jury, compensatory damages, special and general damages, medical expenses, interest, all legal fees and all other relief the court deems just. She is represented by attorney R. Michael Lieberman of Law Offices of R. Michael Lieberman in San Francisco.
