Fresno consumer alleges alleges debt collector violated FDCPA

SACRAMENTO — A Fresno County woman is suing  a debt collector, alleging misrepresentation.

Beth Rosas filed a complaint on Aug. 3 in U.S. District Court for the Eastern District of California against D. Scott Carruthers alleging that the debt collector contacted the plaintiff several times in an attempt to collect an alleged debt in violation of the Fair Debt Collection Practices Act.

According to the complaint, Rosas suffered damages from receiving several collection attempts. The plaintiff alleges Carruthers illegally contacted the plaintiff's daughter and disclosed her debt.

Rosas seeks trial by jury, actual damages, statutory damages up to $1,000, legal fees and all the court deems just. She is represented by attorneys Crosby S. Connolly and Robert L. Hyde of Hyde & Swigart in San Diego.
