LOS ANGELES — A Los Angeles County woman is suing the University of Southern California insurance plan administrator, alleging breach of contract and violation of the Employee Retirement Income Security Act.

Simanthia Gaspard filed a complaint Aug. 7 in U.S. District Court for the Central District of California against University of Southern California Long-Term Disability Benefit Plan, alleging the plan administrator denied her claim for disability benefits.

According to the complaint, Gaspard became totally disabled in 2011 and applied for disability benefits. The suit says these benefits were initially approved until her benefits were suddenly terminated in July 2016. 

The plaintiff alleges the defendant wrongfully terminated her disability benefits despite Gaspard still being disabled according to the terms of the plan.

Gaspard seeks plan benefits due and owing, all employee benefits, legal fees and all other relief the court deems just. She is represented by attorney Robert F. Keehn of Law Office of Robert F. Keehn in Los Angeles.
