California paint services company alleges violation of Miller Act

SAN JOSE — A California paint services company is suing several companies, alleging breach of contract and negligence.

The United States of America, for the use and benefit of Trombley Enterprises, LLC, doing business as Trombley Painting Company, filed a complaint Aug. 9 in U.S. District Court for the Northern District of California San Jose Division against Sauer, Inc., Sauer Group, Inc., Federal Insurance Company, alleging they failed to settle their debt to the plaintiff.

According to the complaint, Trombley Painting suffered monetary damages from not being paid more than $ 1 million for its services. The plaintiff alleges the defendants failed and has refused to perform their obligation to their contractual agreement with the plaintiff by paying them for services and materials provided for a project at the Fort Hunter Liggett Army base in California.

The plaintiffs seeks trial by jury, general, special and consequential damages, interest, all legal fees, the principal sum of $1,045,234.14, and all other relief the court deems just. They are represented by attorneys Roger B. Frederickson and Caroline O. Burgess of Frederickson Law Group in San Luis Obispo.
