Labor union accuses steel casing business of breach of contract

SAN FRANCISCO — A labor union is suing suing a steel casting company, alleging breach of contract.

The Board of Trustees of the CMTA-Glass, Molders, Pottery, Plastics and Allied Workers Local 164B Health and Welfare Trust and the CMTA-Glass, Molders, Pottery, Plastics and Allied Workers Local 164B Pension Trust filed a complaint Aug. 9 in U.S. District Court for the Northern District of California against Pacific Steel Casting Company LLC, and Does 1 through 10, alleging they failed to pay their monthly contribution to the plaintiff.

According to the complaint, the plaintiffs suffered monetary damages due to unpaid and late paid contributions. The plaintiffs allege the defendants breached their bargaining agreement by failing to make their contribution on behalf of the plaintiffs' employees.

The plaintiffs seek fringe benefit contributions, liquidated damages, actual damages, enjoin the defendant, legal fees, audit costs, interest and all other relief the court deems just. They are represented by attorney Concepcion E. Lozano-Batistaa of Weinberg, Roger & Rosenfeld in Alameda, California.
