City employee alleges San Francisco violated family leave law

SAN FRANCISCO — An Alameda County man is suing the city of San Francisco, alleging discrimination, retaliation, violation of the Family and Medical Leave Act and violation of workers compensation acts.

De'Mario Grant filed a complaint Aug. 22 in the U.S. District Court for the Northern District of California against the city and county of San Francisco, the Fine Arts Museums of San Francisco, Hugo Gray, Charles Castillo and Does 1 through 50, alleging that they interfered with the plaintiff's FMLA rights.

According to the complaint, Grant, a museum guard who suffers from physical disabilities related to his back, suffered damages from being terminated from his employment after asking for a FMLA protected leave. The plaintiff alleges the defendants say Grant was lying about having a disability and illegally terminated his employment.

Grant seeks trial by jury, special, general, and compensatory damages, liquidated damages, treble damages, punitive damages, interest, legal fees and all other relief the court deems just. He is represented by attorney Joan Herrington of Bay Area Employment Law Office in Oakland.
