Employee alleges technology business failed to pay overtime

SACRAMENTO — An employee has filed a class action lawsuit against a technology firm, alleging unpaid wages and violation of the Fair Labor Standards Act.

Debi Mishra filed a complaint, individually and on behalf of all those similarly situated, Aug. 25 in U.S. District Court for the Eastern District of California against Cognizant Technology Solutions Corporation, and Does 1 through 10, alleging that they failed to pay fair wages to the plaintiff.

According to the complaint, Mishra worked for more than 40 hours per week without being paid any overtime wages. The plaintiff alleges Cognizant Technology failed to provide accurate pay stubs to Mishra for her work as well as pay wages at a timely manner, violating FLSA.

Mishra seeks trial by jury, overtime wages, statutory wages, statutory damages, actual damages, disgorgement, restitution, punitive damages, legal fees, and any other relief the court deems just. She is represented by attorneys John T. Stralen and Joshua H. Watson of Clayeo C. Arnold APC in Sacramento.
