Customer accuses Comcast of violating phone privacy statute

SACRAMENTO — A San Joaquin County man is suing Comcast, alleging violation of telephone harassment statutes.

Mark Walch filed a complaint Sept. 6 in U.S. District Court for the Eastern District of California against Comcast Cable Communications Management LLC, alleging the defendant illegally called the plaintiff several times in an attempt to collect an alleged debt, violating the Telephone Consumer Protection Act.

According to the complaint, in 2016 Walch suffered damages from receiving several illegal collection calls. The plaintiff alleges Comcast kept calling him to collect an alleged debt by illegally using an automated artificial pre-recorded message.

Walch seeks trial by jury, $500 in statutory damages, actual damages, injuntive relief, $1,500 in treble statutory damages, statutory damages of $1,000 and all other relief the court deems just.
