Labor groups accuse California construction business of violating ERISA

SAN FRANCISCO — Labor groups are suing a California construction company, alleging breach of contract and violation of the Employee Retirement Income Savings Act.

Board of Trustees of the Laborers Health and Welfare Trust Fund for Northern California, Board of Trustees of the Laborers Vacation-Holiday Trust Fund for Northern California, Board of Trustee of Laborers Pension Trust Fund for Northern California and Board of Trustees of the Laborers Training and Retraining Trust Fund for Northern California filed a complaint Sept. 11 in U.S. District Court for the Northern District of California against Cazadores Construction Inc., alleging the defendant failed to make its monthly contribution to the labor groups.

According to the complaint, the plaintiffs suffered monetary damages due to unpaid and late contributions. The plaintiffs alleges Cazadores Construction failed to remit the employees' contribution to the labor group.

The plaintiffs seek damages for breach of the collective bargaining agreement, unpaid contribution in the principal amount of $100,651.23, plus interest and liquidated damages of $450, interest at the rate of 1.5 percent per month calculated to be $85,798.94 through July 26, legal fees and all other relief the court deems just. They are represented by attorney Ronald L. Richman of Bullivant Houser Bailey PC in San Francisco.
