FRESNO — An Arizona woman who requires a wheelchair is suing a Holiday Inn Express operator, alleging disability discrimination and failure to uphold Americans with Disabilities Act regulations.
Theresa Brooke of Pinal County, Arizona, filed a complaint Dec. 7 in U.S. District Court for the Central District of California against Thandi Enterprises LLC, alleging the defendant denied full access to the physically disabled.
According to the complaint, on Nov. 22, 2016, Brooke was at the Holiday Inn Express Fresno where she discovered the defendant continued to violate the ADA by failing to provide access to the pool facilities both then and upon Brooke's return to the property as a guest.
The plaintiff alleges Thandi Enterprises violated the rights of Brooke to fully access a public lodging facility and failed to remove architectural barriers to make its lodging services fully accessible.
Brooke seeks trial by jury, damages of no less than $4,000, costs of suit, attorney fees, nominal damages, order closure until the defendant has fully complied with the ADA and all other relief the court deems just. She is represented by attorney Peter Kristofer Strojnik of The Strojnik Firm LLC in Phoenix.
