FRESNO — A customer is suing a Lithia dealership and agents, alleging breach of contract and unfair competition.
Dezeray V. Flores filed a complaint Nov. 29 in Fresno County Superior Court against Lithia NF Inc., and Does 1-75, alleging they breached good faith and fair dealing.
According to the complaint, beginning Sept. 13, Flores suffered monetary injury upon entering into a retail installment sale contract (RISC1) to purchase a new vehicle from the defendants, while trading in an older Nissan Altima vehicle. However, the suit says, the defendants failed to pay off Flores' prior credit balance on the trade-in vehicle, which caused damages to the plaintiff's credit standing.
The plaintiff alleges the defendants failed to perform its duty according to the terms of the sale contract.
Flores seeks trial by jury, compensatory, general, actual, and special damages, restitution of all monies expended, incidental and consequential damages, statutory damages, equitable and injunctive relief, pre-judgment interest, attorney fees and costs of suit, and all further relief the court deems just.
