LOS ANGELES – A Nashville, Tennessee man alleges a telemarketer based in Los Angeles County unlawfully called him to solicit promotional marketing items.

Craig Cunningham, individually and on behalf of all others similarly situated, filed a complaint on May 18 in the U.S. District Court for the Central District of California against Nationwide Business Resources Inc. and Does 1 to 10 alleging that they violated the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that beginning in March, he received numerous calls from Nationwide Business Resources seeking to solicit its products. As a result, the plaintiff alleges he suffered an invasion of his legally protected interest in privacy.

The plaintiff holds Nationwide Business Resources Inc. and Does 1 to 10 responsible because despite his request to place him on the defendants' do-not-call list, the defendants allegedly continued to make calls using an automatic telephone dialing system and/or an artificial or prerecorded voice.

The plaintiff requests a trial by jury and seeks statutory damages of $500 for each and every negligent violation, treble damages of $1,500 for each and every willful violation and such other just and proper relief. He is represented by Todd M. Friedman, Adrian R. Bacon, Meghan E. George and Thomas E. Wheeler of Law Offices of Todd M. Friedman in Woodland Hills.
