LOS ANGELES – A consumer alleges a debt collector contacted her 30 times after she revoked her consent to be contacted.
Candice Juarez filed a complaint on July 27 in the U.S. District Court for the Central District of California against Alltran Financial LP over alleged violation of the Telephone Consumer Protection Act and Fair Debt Collection Practices Act.
According to the complaint, beginning in March, Juarez began receiving calls from defendant in its attempt to collect an alleged debt. On March 9 during a conversation with one of defendant's representatives, Juarez alleges she revoked consent to be contacted any further, but the calls still continued. She alleges the defendant called her 30 times between March 5 and May 2.
The plaintiff holds Alltran Financial LP responsible because the defendant allegedly engaged in conduct of which the natural consequences is to harass, oppress, or abuse any person in connection with the collection of a debt.
The plaintiff requests a trial by jury and seeks for actual, statutory and punitive damages; costs; attorneys' fees; pre- and post-judgment interest; and any other relief that the court deems appropriate. She is represented by Brian Brazier of Price Law Group APC in Scottsdale, Arizona.
