Former Central California Truck and Trailer Sales employee alleges wages were wrongfully converted

FRESNO – A former employee of two Fresno-based companies alleges he is owed unpaid wages.

Gilbert Ruiz filed a complaint on Aug. 2 in the Fresno County Superior Court against Central California Truck and Trailer Sales LLC, Rush Truck Centers of California Inc., Betty Hartwick and Does 1 through 20 over alleged violation of the California Labor Code.

According to the complaint, between November 2014 and June 1, 2017, Ruiz was employed by the defendants and worked more than eight hours per day and more than 40 hours per workweek with work periods of more than five hours without a meal period. 

The plaintiff claims he has been deprived of his rightfully earned wages, he did not receive accurate wage and hour statements and the defendants converted his wages for their own use and benefit. 

The plaintiff holds Central California Truck and Trailer Sales LLC, Rush Truck Centers of California Inc., Hartwick and Does 1 through 20 responsible because the defendants allegedly also failed to pay plaintiff minimum and overtime wages for his work.

The plaintiff requests a trial by jury and seeks judgment for unpaid wages, punitive damages, prejudgment interest, attorney fees, costs of suit, injunctive relief and for such further relief as the court may deem appropriate.
