Grant & Weber alleged to have attempted to collect amount it cannot legally collect

SAN DIEGO – A debt collector is accused of "abusive and outrageous conduct" by a San Diego County man.

Richard J. Meier filed a complaint on Aug. 8 in the U.S. District Court for the Southern District of California against Grant & Weber Inc. alleging violation of the Fair Debt Collection Practices Act and the Rosenthal Act.

According to the complaint, the plaintiff alleges that on June 27, the defendant contacted him regarding an alleged debt. The suit states the defendant told the plaintiff that the alleged debt had not been reported to the credit bureaus and asked how the plaintiff wished to pay. The plaintiff alleges the defendant had no intent or ability to report the account to the credit bureaus.

The plaintiff holds Grant & Weber Inc. responsible because the defendant allegedly threatened to collect an amount that it could not legally collect and made false representations during the collection of a consumer debt.

The plaintiff requests a trial by jury and seeks judgment against defendant for an award of actual and statutory damages, costs of litigation, attorney’s fees and all other remedies. He is represented by Richard J. Meier of Meier LLC in San Diego.
