Citrus farmers allege no more is owed to Agri-Valley Irrigation under contracts

Lawsuits
Contract 06

FRESNO – Two citrus farmers allege they have paid the amount due under two contracts with a Fresno County business, but the business claims they owe thousands more.

Adrian Marquez & Wilma Maria Marquez, doing business as A&W Farms, filed a complaint on Aug. 22 in the Fresno County Superior Court against Agri-Valley Irrigation LLC seeking declaratory relief.

According to the complaint, on June 1, 2016, the plaintiffs and the defendant entered into two related contracts pursuant to which the defendant agreed to provide labor and materials to upgrade an irrigation system owned by A&W Farms.

The plaintiffs claim they have paid the full amount of $34,170.43 under the Sand Media Contract and the full amount of $32,873.12 under the Jet System Contract, and they contend that no further monies are owed to defendant. The suit states the defendant alleges another $39,004 is owed to it, plus interest and/or late fees.

The plaintiffs seek a judicial determination of their rights and duties.

The plaintiffs seek declaration of monies owed, costs incurred, and for such other and further relief as the court may deem just and proper. They are represented by Charles L. Doerksen of Doerksen Taylor Stokes LLP in Fresno.
