Former bus driver for First Student alleges cancer diagnosis was factor in termination

SACRAMENTO – A school bus driver alleges she lost her job earlier this year because of her medical condition.

Stephanie Morrow filed a complaint on Sept. 11 in the U.S. District Court for the Eastern District of California against First Student Inc. and Does 1 through 20 over alleged violation of the Fair Employment and Housing Act.

According to the complaint, the plaintiff was hired by the defendant as a bus driver in 2001. She alleges she was diagnosed with cancer in 2017 and took Family and Medical Leave Act leave to receive chemotherapy treatment from June 2017 to March 2018. She also claims she notified defendant of her illness, yet it allegedly never met with or discussed with her any possible reasonable accommodations. She alleges she was terminated Jan. 16.

The plaintiff holds First Student Inc. responsible because her cancer diagnosis allegedly was a substantial motivating reason for the defendant's decision to terminate her.

The plaintiff requests a trial by jury and seeks judgment for actual, special and general damages; costs of suit; exemplary damages; pre- and post-judgment interest; attorney's fees; and all other relief the court deems appropriate.
