Consumer seeks rescission of sales contract of Ford vehicle she alleges has defects

OROVILLE – An Oroville consumer alleges a vehicle she purchased earlier this year has serious defects and is seeking rescission of the purchase contract.

Janette Stultz filed a complaint on Oct. 2 in the Butte Superior Court against Ford Motor Co. alleging that the automobile company violation of the Song-Beverly Consumer Warranty Act and Magnuson-Moss Act.

According to the complaint, on Feb. 20, Stultz purchased a 2015 Ford Focus from defendant that was allegedly delivered with serious defects and nonconformities to warranty. Plaintiff also claims the nonconformities substantially impair the use, value and/or safety of the vehicle. 

The plaintiff holds Ford Motor Co. responsible because the defendant allegedly failed to repair the defects and nonconformities or replace or repurchase the vehicle.

The plaintiff requests a trial by jury and seeks judgment for general, special and actual damages; rescission of the purchase contract; civil penalty; prejudgment interest; attorney's fees; costs of suit; and such other and further relief as the court deems just and proper.
