Child sues for murder of father while in prison, says guards allowed it

SACRAMENTO -- D.G., a minor, by and through her guardian ad litem Maria Sara Camargo, and the Estate of Luis Giovanny Aguilar, deceased, filed a complaint on October 11 in the Eastern District of California against unknown defendants for excessive force, deliberate indifference, negligence resulting in wrongful death, substantive due process - loss of parent/child relationship and wrongful death.

According to the complaint, on Dec. 12, 2019, Luis Aguilar was an inmate at CSP Sacramento when he was murdered by three other inmates. Plaintiffs allege that prison guards were willfully indifferent to prevent the murder of Aguilar and the defendants' wrongful acts included recruiting and allowing inmates to carry out the murder. 

Plaintiffs are informed and believe there is a video of a practice run wherein prison guards allowed the three inmates to practice how they would carry out the murder and video of the murder itself. 

Plaintiffs allege that it was also due to the prison guards' deliberate indifference, negligence, recklessness, and flagrant failure to supervise inmates or protect inmates that allowed the murder to take place. D.G. is the minor daughter of Aguilar.

Plaintiffs seek compensatory and punitive damages, cost of suit and attorney's fees. Plaintiffs are represented by Kresta Nora Daly of the Law Office of Mark A. Redmond PC Barth Daly LLP.
