Class action accuses Fort Point Beer Co. of allegedly shorting worker pay

 A class action lawsuit accuses Fort Point Beer Company of allegedly shorting worker wages, among other alleged violations of California labor law.  

"Plaintiff seeks damages for unpaid wages, unpaid meal and rest break premiums, unreimbursed business expenses, unpaid monies (e.g., accrued gratuities) penalties, interest, and reasonable attorneys’ fees and costs under [the[ California Labor Code," states the lawsuit, filed in San Francisco Superior Court.

The lawsuit was filed on behalf of named plaintiff John Price, identified as a resident of San Francisco County.

The company "engaged in a pattern and practice of wage abuse against their hourly-paid and/or non-exempt employees," the suit alleges.

That included requiring employees to work "off-the-clock” in tasks such as "opening Employer’s premises and setting up the facility before clocking in,"  working while on meal breaks and performing "typical job duties such as providing service to customers just after clock out," according to the suit.

The company also allegedly required employees to read "and respond to messages on Slack messenger in between shifts, or else receiving and having to respond to work-related communications between shifts" without pay, the suit alleges.

It seeks unpaid wages, damages and attorney fees.

The plaintiffs are represented by attorneys Jonathan M. Genish, Barbara DuVan-Clarke, Alexander K. Spellman and P.J. Van Ert, of Blackstone Law APC, of Beverly Hills.
