Mary Ramisetty sues General Motors for violation of the Song-Beverly Consumer Warranty Act and breach of express and implied warranties

Mary Ramisetty has filed a lawsuit against General Motors, LLC in the Superior Court of California, Santa Clara County. The case, numbered 24C¥ 434850, was filed on April 9, 2024. The plaintiff is represented by attorneys Neal F. Morrow III, Rene J. Dupart, Joseph D. Steward III and Michael J. Avila from MEFS Legal, Inc.

The complaint alleges that Ramisetty purchased a 2019 Chevrolet Bolt from General Motors on April 17, 2019. However, the vehicle allegedly had defects that substantially impaired its use, value and safety. Despite multiple repair attempts at authorized facilities, the issues were not resolved.

Ramisetty accuses General Motors of violating the Song-Beverly Consumer Warranty Act by failing to conform the vehicle to express written warranties within a reasonable number of repair attempts or warranty periods. She also alleges that the company failed to replace the vehicle or make restitution promptly.

In her suit, Ramisetty seeks damages and injunctive relief for alleged violations of consumer warranty laws and breach of express and implied warranties. She claims actual, incidental and consequential damages in an amount equal to the purchase price of the vehicle and is seeking a civil penalty of two times her actual damages under California Civil Code §1794(c). Additionally, she is asking for attorney’s fees and expenses under California Civil Code §1794(d).
