Hartford Life Insurance Co. accused of violating of ERISA

SACRAMENTO – A former human resources manager is suing her insurance company over claims it unlawfully denied her claims for long-term disability benefits.

Jemiah Hernandez filed a complaint on Feb. 29 in the U.S. District Court Eastern District of California against Hartford Life Insurance Co. and Does 1 to 100, citing breach of the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that, between March 13, 2015, and Nov. 9, 2015, she applied for long-term disability benefits from her employer but was denied. The suit states she suffers from chronic pain. The plaintiff holds the defendants responsible because they "unreasonably, arbitrarily and capriciously" withheld her benefits, the suit states.

The plaintiff seeks the following: compensation for all damages including interest, legal fees and any other relief the court deems just and proper. She is represented by David Allen of David Allen & Associates in Sacramento.
