SAN FRANCISCO – A Kentucky man alleges that a pharmaceutical company knowingly sold defective products to consumers.

Terrence Hayes filed a complaint on March 3 in the U.S. District Court for the Northern District of California against Pfizer Inc., citing alleged breach of implied warranty, fraud, negligence, negligent misrepresentation and other counts.

According to the complaint, the plaintiff alleges that he used Viagra from January 2013 to June 2015. The suit states he was diagnosed with melanoma on his face in April 2015 allegedly due to usage of Viagra and had to undergo surgery. The plaintiff holds Pfizer Inc. responsible because the defendant allegedly failed to warn users about the potential risks of using Viagra.

The plaintiff seeks the following: compensation for all damages, legal fees and any other relief as the court deems just and proper. He is represented by Rachel B. Abrams and Meghan McCormick of Levin Simes LLP in San Francisco and Ernest Cory, Kristian W. Rasmussen and Lauren S. Miller of Cory Watson P.C. in Birmingham, Alabama.
