Malibu Media sues Doe over alleged copyright infringement

SAN FRANCISCO – A media company is suing an unknown BitTorrent user over allegations the user violated copyright laws.

Malibu Media LLC filed a complaint on Feb. 29 in the U.S. District Court for the Northern District of California, San Francisco Division against John Doe subscriber assigned Internet Protocol address 67.164.74.212, citing copyright infringement.

According to the complaint, the plaintiff alleges that it sustained damages to its business due to its movies being distributed without consent. The plaintiff holds John Doe responsible because the defendant allegedly used BitTorrent software to download copies of the plaintiff's works and distribute them without authority from the plaintiff.

The plaintiff seeks the following: compensation for all damages, an order that the defendant delete infringing copies of plaintiff's work, legal fees and any other relief as the court deems just and proper. It is represented by Brenna E. Erlbaum and Brian Heit of Heit Erlbaum LLP in Newbury Park.
