Malibu Media sues subscriber over alleged copyright infringement

SACRAMENTO – A Los Angeles media company alleges that an unknown Internet user has illegally distributed its movies over BitTorrent.

Malibu Media LLC filed a complaint on March 30 in the U.S. District Court for the Eastern District of California against John Doe subscriber-assigned Internet Protocol address 76.20.63.241, alleging that the subscriber wrongfully distributed unauthorized copies of plaintiffs property.

According to the complaint, the plaintiff alleges that it suffered damages to its business as a result of its property being distributed illegally. The plaintiff holds John Doe subscriber-assigned IP address 76.20.63.241 responsible because the defendant allegedly used BitTorrent software to download copies of plaintiff's property and distribute them using the network.

The plaintiff seeks a trial by jury, to enjoin the defendant from continuing to infringe plaintiff's copyrighted works, order that the defendant delete all copies and media files relating to plaintiff's property, damages per infringed work, all legal fees and any other relief as this court deems just.
