SAN FRANCISCO – An unknown BitTorrent user is facing a lawsuit from a Los Angeles company over allegations that the user
wrongfully distributed unauthorized copies of the company's property.
Malibu Media LLC filed a complaint on March 31 in the U.S. District Court for the Northern District of California against John Doe subscriber-assigned IP address 188.8.131.52, citing copyright infringement.
According to the complaint, the plaintiff alleges that it suffered damages to its business as a result of its property being distributed illegally. The plaintiff holds John Doe subscriber-assigned IP address 184.108.40.206 responsible because the defendant allegedly used BitTorrent software to download copies of plaintiff's property and distribute them using the network.
The plaintiff seeks trial by jury, to enjoin the defendant from continuing to infringe plaintiff's copyrighted works, an order that the defendant delete all copies and media files relating to plaintiff's property, damages per infringed work, all legal fees and any other relief as this court deems just. It is represented by Brian Heit and Brenna E. Erlbaum of Heit Erlbaum LLP in Woodland Hills.
