SAN FRANCISCO – A man has filed a class-action suit against his former employers alleging that they failed to fairly compensate their employees.
Jose Gonzalez filed a complaint on behalf of himself and of those similarly situated individuals on April 8 in the U.S. District Court for the Northern District of California against Fallanghina LLC, doing business as Pasan Osteria; Long Branch Berkeley LLC, doing business as Long Branch Saloon; Hal Brandel; and Walter Wright, citing violation of the Fair Labor Standards Act.
According to the complaint, the plaintiff alleges that he worked for more than 40 hours per work week but did not receive any overtime pay for all extra hours rendered. The plaintiff holds the defendants responsible because the defendants also allegedly failed to adequately compensate their employees by providing meal breaks.
The plaintiff requests a trial by jury and seeks compensatory and economic damages for unpaid wages, meal and rest breaks in amount to be proven in trial; interest; liquidated damages; restitution of unpaid overtime and minimum wages; all legal fees and any other relief as this court deems just.
