Suit filed over use of Just Windows mark

SAN FRANCISCO – A San Jose company has filed a suit against another San Jose business over allegations of trademark infringement.

Crystal Janitorial Service Inc. filed a complaint on April 19 in the U.S. District Court for the Northern District of California against Richard Rogers, Just Windows & Maintenance Service Inc. and Just Windows LLC, citing trademark infringement, false designation, unfair business practices and other counts.

According to the complaint, the plaintiff alleges that it owns the federally registered service mark Just Windows and has been using it since 1992. The plaintiff holds Richard Rogers, Just Windows & Maintenance Service Inc. and Just Windows LLC responsible because the defendants allegedly used a similar mark without permission from them.

The plaintiff requests a trial by jury and seeks preliminary and permanent injunction against the defendants, order for all labels bearing plaintiff's mark be sent to plaintiff for destruction, judgment requiring the defendants to account to plaintiff all profits derived from defendants' misconduct, award plaintiff all damages, all legal fees and any other relief as this court deems just.
