SACRAMENTO – A Sacramento man has filed a class-action lawsuit against a debt collector claiming it used an automatic telephone dialing system to collect an alleged debt.

Mike Esposito filed a complaint on behalf of all others similarly situated on May 10 in the U.S. District Court for the Eastern District of California against D2 Management LLC and Does 1 through 10 citing violation of the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that in January he received calls daily from the defendants and was charged for the calls. The plaintiff holds D2 Management LLC and Does 1 through 10 responsible because the defendants allegedly kept on calling plaintiff despite his requests to stop and that he never gave his consent to the defendants to call.

The plaintiff requests a trial by jury and seeks $500 in statutory damages for each violation, $1,500 in treble damages for each violation, all legal fees and any other relief as the court deems just.
