Google seeks declaration regarding Google Play Music app

SAN FRANCISCO – A Mountain View company seeks declaration from the court regarding a patent dispute.

Google Inc. filed a complaint on May 16 in the U.S. District Court for the Northern District of California against Creative Labs Inc. and Creative Technology LTD, seeking declaratory judgment of non-infringement of patent No. 6,928,433 owned by the defendants.

According to the complaint, the plaintiff alleges that the defendants accuse it patent infringement with its Google Play Music app. The plaintiff claims the app does not infringe the patent in suit.

The plaintiff requests a trial by jury and seeks declare that Google Play Music app does not infringe the '433 patent, enjoin the defendant from claiming that the app infringes the '433 patent, all legal fees and any other relief as this court deems just. It is represented by Bijal V. Vakil and Allen Wang of White & Case LLP in Palo Alto.
