Veteran files medical malpractice suit, alleges surgery caused paralysis

SACRAMENTO – A veteran has filed suit alleging that a surgery performed at a government medical center made his health conditions worse.

Roger McCullar filed a complaint on May 31 in the U.S. District Court for the Eastern District of California against United States of America, Department of the Air Force, David Grant USAF Medical Center, Department of Veterans Affairs, and Dr. Narayana Swamy, and Does 1 through 200 alleging medical malpractice and product liability.

According to the complaint, the plaintiff alleges that in 2014, he suffered severe injuries as well as being paralyzed and losing sensation throughout his body after a cervical disk surgery at David Grant Medical Center. The plaintiff holds the defendants responsible because the defendants allegedly used defective allograft materials during the surgery and committed other negligent acts during the procedure.

The plaintiff requests a trial by jury and seeks general damages, all medical expenses, loss of earnings and benefits, interest, all legal fees and any other relief as this court deems just. He is represented by David E. Smith and Elisa R. Zitano of Smith Zitano Law Firm LLP in Sacramento.
