Transcend Technologies Group Inc. claims software was copied

SACRAMENTO – A Rancho Cordova software maker alleges a competitor copied its software and sold it under a different name.

Transcend Technologies Group Inc., doing business as benefitsCONNECT, filed a complaint on June 27 in the U.S. District Court for the Eastern District of California against Mass Group Marketing Inc., Kelly Beesley and Does 1 through 10 alleging copyright infringement and breach of contract.

According to the complaint, the plaintiff alleges that it suffered damages to its business as a result of unauthorized copies of its benefitsCONNECT software being sold by the defendants. The plaintiff holds Mass Group Marketing Inc., Kelly Beesley and Does 1 through 10 responsible because the defendants allegedly made unauthorized copies of plaintiff's software and as well as making their own software derived from plaintiff's software, and then marketed it as their own under the name THEbenefitsHUB.

The plaintiff seeks to enjoin the defendants, seize and impound all copies of the defendants' software, actual damages, statutory damages, accounting for all gains and profits, all legal fees and any other relief as the court deems just.
