Neman Brothers & Associates Inc. files suit alleging infringement of fabric print

LOS ANGELES – A Los Angeles textile converter alleges two businesses have used fabric prints that are copies of the plaintiff's copyright work.

Neman Brothers & Associates Inc. filed a complaint on July 8 in the U.S. District Court for the Central District of California against Minette Apparel LLC, Ross Stores Inc., doing business as DD'S Discounts, and Does 1-10 alleging copyright infringement.

According to the complaint, the plaintiff alleges that it suffered damages as a result of its copyrighted designs being used without its authority. The plaintiff holds Minette Apparel LLC, Ross Stores Inc. and Does 1-10 responsible because the defendants allegedly sell and fabric that bear a similar design to plaintiff's.

The plaintiff requests a trial by jury and seeks to enjoin the defendants from further infringing plaintiff's design, award plaintiff all profits, statutory damages, interest, all legal fees and any other relief as the court deems just.
