Woman files suit seeking disability benefits

SAN JOSE – A Los Angeles County woman alleges she qualifies for disability benefits but was wrongfully denied.

Kelly Brooks filed a complaint on July 15 in the U.S. District Court for the Northern District of California, San Jose Division against Life Insurance Co. of North America and Apple Inc. Long Term Disability Plan alleging violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that in May 2015, she became disabled and applied for disability benefits but was denied by the defendants in February. The plaintiff holds Life Insurance Co. of North America and Apple Inc. Long Term Disability Plan responsible because the defendants allegedly upheld their decision to deny disability benefits to plaintiff despite being entitled to those benefits according to the terms of the plan.

The plaintiff seeks payment of disability benefits to plaintiff, reinstatement, all legal fees and interest, and any other relief as the court deems just. She is represented by Glenn R. Kantor, Alan E. Kassan and Mitchell O. Hefter of Kantor & Kantor LLP in Northridge.
