Man alleges surgery should be covered by DSW plan

LOS ANGELES – A man has filed suit against his employer and his medical plan seeking reimbursement for a surgery he claims should be covered under the plan.

Chad Amerine filed a complaint on Aug. 3 in the U.S. District Court for the Central District of California against DSW Inc., DSW Inc. Benefit Plan and Does 1-10 alleging breach of plan.

According to the complaint, the plaintiff alleges that in January, he underwent a cochlear implant surgery but the defendants denied his coverage claim. The plaintiff holds DSW Inc., DSW Inc. Benefit Plan and Does 1-10 responsible because the defendants allegedly denied plaintiff's claim despite the plan stating all medically necessary care is covered, and the plaintiff claims this surgery fell into that category.

The plaintiff seeks benefits payable under the plan to reimburse plaintiff, interest, all legal fees and any other relief as the court deems just. He is represented by Christian J. Garris of Law Offices of Christian J. Garris in Los Angeles.
