Textile designs were used without permission, Star Fabrics claims

LOS ANGELES – A textile manufacturer alleges its designs were unlawfully used in clothing and sold nationwide by three companies.

Star Fabrics Inc. filed a complaint on Aug. 15 in the U.S. District Court for the Central District of California against the Myth Clothing Co. Inc., The TJX Cos. Inc., Burlington Coat Factory Direct Corp. and Does 1-10 alleging copyright infringement.

According to the complaint, the plaintiff alleges that its Subject Design A/66101 and Subject Design B/68939 designs were used by the defendants without authorization.  The plaintiff holds Myth Clothing Co. Inc., The TJX Cos. Inc., Burlington Coat Factory Direct Corp. and Does 1-10 responsible because the defendants allegedly used the plaintiff's creative works to sell garments nationwide, online and through catalogues.

The plaintiff requests a trial by jury and seeks judgment against the defendants, be awarded all profits, statutory damages, attorneys’ fees, interest, costs of this action and other relief as the court deems proper.
