GAINESVILLE — An individual has filed suit against an insurance company for allegedly denying her claim for disability benefits.
Jessica L. Barnes filed a complaint Sept. 2 in U.S. District Court for the Northern District of Florida against Aetna Life Insurance Co., alleging that the plan administrator violated her rights as an employee.
According to the complaint, the plaintiff alleges that on Aug. 15, 2008, she became disabled and unable to work due to fibromyalgia, carpal tunnel syndrome, mood disorder, chronic fatigue, chronic pain, lumbago, depression, anxiety, headaches, rheumatology disorder and other impairments. She supposedly received disability benefits from April 28, 2009, through Oct. 31, 2015, until she was denied further claims. The plaintiff holds Aetna Life Insurance Co. responsible because the defendant allegedly failed to uphold the rights of the plaintiff to disability benefits and failed to fulfill its fiduciary duties in good faith.
The plaintiff requests a trial by jury and seeks judgment against the defendant for all plan benefits owed, prejudgment interest, attorney’s fees, costs of this action and all other relief as deemed just. She is represented by Nick A. Ortiz of Ortiz Law Firm in Pensacola.
